Terms of Use

The rules for using TakeawayDriver and taking part in the launch network.

1. About these terms

These terms apply when you access TakeawayDriver, register as a TakeAway Driver or Launch Takeaway Business, submit or respond to a driver request, or otherwise use the platform.

The service is operated by TakeAwayDriver is operated by SOS Communications, operating in England and Wales.

2. What TakeawayDriver does

TakeawayDriver is an introduction and technology platform. It helps independent delivery drivers and takeaway businesses find and contact each other. It does not currently employ drivers, supply labour as an employer, operate a courier fleet, guarantee work, guarantee a driver, set the final price of delivery work, or receive payment for delivery work.

Any work arrangement is made directly between the driver and takeaway. They are responsible for agreeing the scope, timing, price, payment, cancellation, conduct and any other terms.

3. Eligibility and accurate information

You must be at least 18, have legal capacity to enter arrangements, provide accurate and current information, and use the service only for lawful business or delivery purposes. You must promptly update information that becomes inaccurate.

4. Driver responsibilities

Drivers are responsible for determining and maintaining their own legal and tax status, licences, right to work where applicable, suitable vehicle, MOT, roadworthiness, insurance including appropriate hire-and-reward or food-delivery cover where required, equipment, personal safety and compliance with road, food-handling and other applicable laws.

5. Takeaway responsibilities

Takeaways are responsible for lawful operation of their business, food safety, providing accurate job information, agreeing fair and lawful arrangements, checking any matters important to them, maintaining a safe collection environment, paying drivers as agreed and not treating a platform description as a substitute for their own due diligence.

6. Employment and tax status

Labels do not decide employment or tax status; the real working arrangement does. Each party must obtain advice and assess its responsibilities. Nothing in these terms overrides rights that apply by law.

7. Verification

Any verification badge or status means only that specified information was checked at a particular time and to the stated level. It is not a guarantee of identity, ongoing validity, competence, conduct, insurance cover or suitability. See our Verification Policy.

8. Free launch access and future services

Registration and current launch participation are free. We may introduce paid features later, but we will provide clear pricing and additional terms before charging you. We will not convert free participation into a paid subscription without clear notice and agreement.

9. Acceptable use

You must not misuse the platform, impersonate another person, submit false documents, scrape data, bypass security, harass users, discriminate unlawfully, arrange illegal deliveries, transmit malware, or use contact details for unrelated marketing.

10. Availability and changes

The platform is under development. Features may change, pause or be withdrawn. We do not guarantee uninterrupted availability or that an introduction will result in work.

11. Responsibility and liability

We are not a party to arrangements between drivers and takeaways and are not responsible for their acts, omissions, food, vehicles, routes, payment disputes or losses arising from a direct arrangement. To the fullest extent permitted by law, we exclude indirect or consequential loss and loss of profit, business, opportunity or data.

Nothing excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud, or your mandatory legal rights.

12. Suspension and termination

We may restrict or remove access where information appears false, safety or legal concerns arise, these terms are breached, or doing so is reasonably necessary to protect users or the platform. You may stop using the service and ask us to close your registration, subject to records we must retain.

13. Intellectual property

TakeawayDriver branding, website content and software belong to us or our licensors. You may use the service for its intended purpose but may not copy, resell or exploit it without permission.

14. Governing law

These terms are governed by the law of England and Wales. The courts of England and Wales will have jurisdiction, subject to any mandatory rights that allow a consumer to bring proceedings elsewhere.

15. Planned company transition

We currently intend that the platform may later be operated by TakeawayNinja Ltd. No transfer has occurred merely because it is proposed. If it happens, we will update the legal identity and explain any material effect on users.
